What Is CDPAP?
The New York State Medicaid program allows chronically ill or physically disabled individuals who have a medical need for help with activities of daily living (ADLs) or skilled nursing services to arrange for their own care, reimbursable by Medicaid. Simply put, a patient or his/her Designated Representative (DR) can select the individual they choose (Personal Assistant) to administer necessary care, rather than going through an agency. The patient or DR has the responsibility - and the privilege - to hire, train as necessary, supervise, arrange a substitute, and dismiss caregivers as they see fit.

What Are The Eligibility Criteria?
To be eligible for CDPAP, individuals must satisfy the following criteria:
Must be eligible
Must be eligible for or receiving home care services or participating in a long term health care program.
Must be willing and able to participate in the selection, supervision, evaluation, and dismissal of the Personal Assistant.
Must be willing and able to direct the PA in required work tasks or have a legal guardian willing to do so on behalf of the individual.
Why Do I Need A Fiscal Intermediary?
Under Medicaid regulation, reimbursement for self-directed care must be arranged through a recognized Fiscal Intermediary. The role of the Fiscal Intermediary is to process the Personal Assistant's wages and benefits (includes establishing the amount of wages, processing payroll, all taxes, and withholding's, as well as complying with worker's compensation, disability and unemployment insurance requirements). The Fiscal Intermediary is also charged with maintaining records, ensuring program requirement compliance, and informing participating families of their responsibilities and program criteria.
